If the buyer fails to pay the purchase price on time, Service GmbH is entitled from the 9th working day after the purchase of the vehicle to withdraw from the purchase contract with the seller on the one hand and from the purchase contract with the buyer on the other hand and to sell the vehicle again via the online platform ("re-auctioning") or otherwise. 

If Service GmbH makes use of this right and declares its withdrawal from the purchase contract and if damage occurs during a new sale, the buyer must compensate the consignor, Service GmbH and/or CarOnSale for this damage. 

If the buyer has already paid the purchase price but has not collected the vehicle in due time and if it is auctioned off in a further auction, Service GmbH shall reimburse the buyer the purchase price paid less the damage incurred by it.
